根据《中华人民共和国出境入境管理法》,外国人在旅馆以外的住所居住,必须在入住后24小时内,由本人或留宿人前往居住地所属派出所办理住宿登记。目前,北京、上海等部分城市已支持通过官方政务APP在线办理,但仍建议提前确认当地规定。

 

Under the Exit and Entry Administration Law of the People's Republic of China, foreigners staying in non‑hotel accommodationmust register their residence with the local police station within 24 hoursof check‑in, either by themselves or through their host. Currently, some cities like Beijing and Shanghai allow online registration via official government apps, but it is still advisable to confirm local regulations in advance.

Therefore, before signing any contract, always ask the landlord or agent:Does this property allow foreign tenants? Does it support accommodation registration? Some residential compounds are not registered with the public security system, so even if the landlord agrees to rent to you, you cannot legally reside there. Get a clear answer to this question before paying any deposit.

  • 个人房东直租

    Direct Rent from Individual Landlords

 

直接与房屋业主(房东)签订合同,无需支付中介费。但租客需要自行核实房源信息的真实性,并处理租房过程中的所有事务。这类房源通常可以通过 Wellcee、闲鱼(二手交易平台上的租房版块)、小红书 等线上平台,或通过线下社区公告栏等方式寻找。

Rent directly from the property owner, with no agency fee. However, tenants need to verify listing authenticity and handle all matters themselves. Such listings can be found on platforms like Wellcee, Xianyu (a second-hand trading app with rental sections), Xiaohongshu (Little Red Book), or through offline channels.

 

  • 机构化运营 / 长租公寓

    Institutionally Operated / Long-Term Rental Apartments

 

由专业运营机构对房源进行统一标准化管理,服务较好,但租金通常也较高。此类模式又可细分为两种:

Professional management companies standardize and manage properties, offering better services but often at higher rents. These are further divided into:
 
  • 分散式:运营方从不同房东手中收房,房源分散在各个居民小区中(例如 自如)。Decentralized: Units are sourced from different landlords and scattered across various residential communities (e.g., Ziroom / 自如).

  • 集中式:整栋楼由一家机构统一运营,形成独立社区,例如品牌公寓或人才公寓。

Real estate agencies (e.g., Lianjia, Beike) provide professional matching and transaction services. They offer a wide inventory but charge a commission fee (typically one month’s rent, paid by the landlord or the renter). Rental policies and online registration apps may vary between cities.
 
实地看房时,请务必做到:

During physical viewings, make sure to:

 

  • 核实房东身份:要求出示房产证原件和本人身份证。如果是二房东,必须看到原房东的书面转租授权书。
    Verify the landlord’s identity: Ask to see the original property ownership certificate and their personal ID. If dealing with a sub‑lessor, request the original landlord’s written authorization for subletting.
  • 检查房屋硬伤:违规隔断房(隔音差、有被强拆风险)、水电燃气管道老化、墙面发霉漏水、甲醛气味浓烈等,一律避开。
    Inspect for physical defects: Avoid illegal partitioned rooms (poor soundproofing and risk of demolition), aging gas/water/electricity lines, mold or leaks, and strong chemical odors.
  • 感受周边环境:建议白天和夜晚各去看一次,了解治安状况、噪音水平和邻居素质。

警惕“海外房东”骗局:任何自称人在国外、要求你先支付“押金”才能寄钥匙或看房的,100%是诈骗。不见房、不付款,这是铁律。

在中国,口头约定很难作为维权证据。所有关键内容,必须写进合同。

In China, verbal agreements are rarely accepted as evidence in disputes. All key terms must be clearly stated in the contract.

 

签约前请确认以下条款是否清晰:

Before signing, confirm that the following items are clearly specified:

 

  • 租金金额、支付方式(推荐银行转账或微信/支付宝)、支付周期(如“押一付三”)。
    Rent amount, payment method (bank transfer, WeChat Pay, or Alipay are recommended), and payment cycle (e.g., “one month’s deposit plus three months’ rent in advance”).
  • 水费、电费、燃气费、网络费、物业费由谁承担。
    Who bears the costs for water, electricity, gas, internet, and property management fees.
  • 押金数额、退还条件和具体退还时限(例如“退房后7个工作日内”)。
    Deposit amount, refund conditions, and specific refund timeline (e.g., “within 7 working days after move‑out”).
  • 家用电器、管道等自然损耗的维修责任归属。
    Responsibility for repairs of appliances and pipes due to normal wear and tear.
  • 提前退租或房东提前收房的违约责任和赔偿标准。
    Penalties and compensation for early termination by either the tenant or the landlord.
 

特别注意两个词:

Pay special attention to two terms:

 

  • “定金” – 具有担保性质,若你违约放弃承租,定金不予退还。在中国租赁合同中一般都写此“定金”。
    “定金” (earnest money) – non‑refundable if you default on the lease. In Chinese lease agreements, this is generally referred to as a “定金”.
     
  • “订金” – 可退,需看清收据上写的是哪一个。
    “订⾦” (advance payment) – refundable. Always check which term appears on your receipt.
 

关于额外费用:除租金外,通常需支付1~3个月租金的押金,以及半个月至一个月租金的中介费。签约前问清全部一次性费用,避免预算超支。

Extra costs: In addition to rent, you usually need to pay a deposit equivalent to 1–3 months’ rent, plus an agency fee of half to one month’s rent. Ask about all one‑time costs before signing, so you don’t exceed your budget.

 

入住前留证:对房屋所有角落(尤其是已有瑕疵的地方)拍照和录像,并请房东确认。这些影像资料,是退租时防止被无理克扣押金的最有力武器。

办好住宿登记后,你的合法居住身份就有了保障。但日常仍需注意:

Once you have completed accommodation registration, your legal residence status is secure. However, daily precautions remain important:

 

 

  • 谨慎提供个人信息:不要轻易将护照首页照片发给非官方人员。办理登记时,只配合公安系统的正规流程。
    Be careful with personal information: Do not casually share the photo page of your passport with non‑official individuals. When handling registration, only cooperate with official public security procedures.
  • 警惕冒充公检法的电话:如果有人自称“公安局”或“出入境管理局”,说你“护照涉嫌违法”或“签证有问题”,并要求你转账或提供银行卡信息,请立即挂断。中国公检法机关绝不会通过电话远程办案或索要钱财,此类电话均为诈骗。
    Beware of impersonation calls: If someone claims to be from the “Public Security Bureau” or “Exit‑Entry Administration,” saying your “passport is involved in illegal activities” or your “visa has issues,” and asks you to transfer money or provide bank details – hang up immediately. Chinese authorities never handle cases or request money over the phone. Such calls are scams.

租房过程中,如果遭遇押金被恶意克扣、中介欺诈等问题,不必慌张,可按以下顺序处理:

If you encounter issues such as unfair deposit deductions or agent fraud during your tenancy, don’t panic. You can follow these steps in order:

 

1、先协商:与房东或中介直接沟通,表明立场。

Negotiate first: Communicate directly with the landlord or agent to state your position.

 

2、请求调解:若协商无果,可向社区居委会或辖区派出所求助,请他们出面调解。

Seek mediation: If negotiation fails, approach the community committee or the local police station to request mediation.

 

3、行政投诉:拨打12345市民服务热线,或向住建部门、工商部门(12315)投诉。

Administrative complaints: Call the 12345 citizen hotline, or file a complaint with the housing authority or the industry and commerce department (12315).

 

4、报警处理:若涉及诈骗,立即拨打96110反诈专线。

Report to the police: If fraud is involved, call the anti‑fraud hotline 96110 immediately.

 

5、法律诉讼:对于合同纠纷,咨询专业律师,向房屋所在地的人民法院提起诉讼。
